Privacy Notice

We respect your right to privacy. This Privacy Notice sets out details of the information that we may collect from you and how we may use that information, and is provided in accordance with the requirement set by Art. 13 of the GPDR[1]. Please read this Privacy Notice carefully.

  • About Us

    In this Privacy Notice, references to “we” or “us” are to Maersk Container Industry A/S, a company incorporated in Denmark (registered number 13823774), with registered office at Bjerndrupvej 47, 6360 Tinglev, who will be the controller of any personal data processed as described in this Privacy Notice.

  • Collection of Information

    When you access and/or use the Learning Management System (“e-learning”/”LMS”), including registering, completing the training, including assignments, tests or other material, responding to the quiz or test questions or participating in any survey or questionnaire sent to you by us, rating the course or providing comments by sending us an email, we may collect, store and use your personal information in line with this Notice. We may also ask you for information when you report a problem with the e-learning or its part.

    To register and access e-learning we ask for information that is limited to the kinds of information that can be found on a business card: title, first name, last name, job title, employer’s name and address, work e-mail. We may also ask you about your educational history or qualifications in order to understand more about you, as well as language preferences for possible translation of e-learning material in the future (responding to these questions will always be optional, however). We use this information to provide you with the training, certifications, and courses most relevant for you. We will collect your training results and, in conjunction with maintaining your certification(s), your record of participation in training to provide the best user experience to you and to be able to monitor the use of the LMS.

    If you correspond with us by email, the postal service, or other form of communication, we may retain such correspondence and the information contained in it and use it to respond to your inquiry; or to keep a record of your complaint, and the like. As always, if you wish to delete your personal information or otherwise refrain from communicating with you, please contact us (see Section 10).

  • Purpose and Legal Basis for Processing Your Information

    Collection and processing of your personal information is done by us to provide you with an access to and enable the completion of e-learning due to a need to perform a contract concluded between us and your employer, to ensure that you as an employee have undergone necessary training to be able to provide high-quality repair and technical services to our clients.

    The information we request is collected for the following purposes:

    • Your full name and e-mail: to enable you to login to the LMS to create a user and to be able to access e-learning material; for sending you newsletters and other material related to e-learning;
    • Job title information: for us to suggest the most relevant courses for you as a user;
    • Your employer’s name, address, and department: for us to know who your employer (and our counterparty) is;
    • Manager ID/email: for us to provide additional roles to managers so they can see their employees training status;
    • Preferred language (optional): for us to evaluate a need for the e-learning material to be translated into other languages;
    • Training records: to keep a record of the courses that have been completed by you and those that are still awaiting completion.

  • Storage and Retention of Information

    The personal information we collect from you is stored on the server of the cloud-based database of the LMS provider ELEARNINGFORCE International ApS, Europalads 16, 8000 Aarhus C, Denmark, registered number 32139728 (“System Provider”), located in Europe.

    We retain your personal data for the duration of your employer-service provider’s business relationship with us. Your data will be deleted once we get a notification from you or your employer that you are no longer employed by your employer.

  • Security of Your Information

    To help protect the privacy of data and personally identifiable information you transmit through use of the e-learning, we maintain physical, technical and administrative safeguards. We update and test our security technology on an ongoing basis. We restrict access to your personal data to those employees who need to know that information to provide benefits or services to you. In addition, we train our employees about the importance of confidentiality and maintaining the privacy and security of your information. We commit to taking appropriate disciplinary measures to enforce our employees' privacy responsibilities.

  • Disclosure of Your Information (Recipients)

    We do not disclose or sell personal information to any third party and only share it with third parties who are facilitating the delivery of e-learning.

    System Provider, as a third party, will as Data Processor have access to your personal data to the extent needed to ensure correct operation of the LMS and to provide storage of personal information, technical support, retrieval and administration of data on our behalf, if and when requested by us.

    Only our authorized employees with full administrative rights to the LMS have access to your training records and personal information.

    We do not otherwise reveal your personal data to third-parties for their independent use unless: (1) you request or authorize it; (2) it is required by law, (3) to enforce an agreement we have with you, or to protect our rights, property or safety, or the rights, property or safety of our employees or others; (4) the information is provided to our agents, vendors or service providers who perform functions with regards to administering of the e-learning on our behalf.

  • Your Rights

    You enjoy certain rights to request from us access to, rectification or deletion of your personal data, however, subject to certain legal limitations.

    By writing to us (see Section 10 below) you can receive a confirmation as to whether your personal data is being processed by us, and if yes, receive all information regarding that according to the law.

    You can also email us in order to access, correct, delete or update your personal information that is processed by us. We will answer every email as promptly as possible.

    In addition, you can object to the processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information. You can exercise these rights by contacting us using the contact details provided under Section 10 below.

    You have the right to complain to a data protection authority about our collection and use of your personal information.  For more information, please contact your local data protection authority (Contact details for data protection authorities in the European Economic Area and Switzerland are available here).

    You may also refuse to provide your personal data, however it will result in your inability to register as a user thereby preventing you from using any e-learning content.

    E-learning uses cookies. Cookies are small files stored on your computer’s hard drive which are used for record-keeping purposes.
